Plain English summary: Lumi is a mobile app designed to help seniors stay safe and connected with family. It is not a medical device or emergency service. The SOS feature is a helpful tool, but always call 911 directly in a real emergency โ Lumi makes no guarantee that its emergency features will work in all situations. Upon first download, you are required to scroll through and explicitly agree to these Terms and our Privacy Policy before using the app.
Before using Lumi, you are required to scroll through these Terms of Service in their entirety and tap "I Agree" to confirm your acceptance. You may not use the App until you have completed this step.
By tapping "I Agree," you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the App.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Lumi LLC, an Oklahoma limited liability company ("Lumi," "we," "us," or "our"), located in Edmond, Oklahoma.
Lumi is provided as two separate Android applications, and in these Terms "Lumi," "the App," and "the Service" mean both of them together and each of them individually:
These Terms apply to whichever of the two apps you install and use. Installing only one of them does not exempt you from these Terms as to that app.
Use of the App constitutes your acceptance of these Terms. Any access to or use of Lumi โ whether or not you have expressly tapped "I Agree" โ constitutes your agreement to be bound by these Terms and our Privacy Policy.
We reserve the right to update these Terms at any time. Continued use of Lumi after any update constitutes your acceptance of the revised Terms. When we make material changes, we will notify you within the App and update the date at the top of this page.
Lumi is an Android application designed to help seniors stay safe and connected with family. It replaces the default Android home screen with a simplified, large-text design and provides features including emergency SOS alerts, medication reminders, scam call and SMS protection, real-time location sharing with family supporters, and a family supporter dashboard.
Lumi is not a medical device. It is not regulated by the U.S. Food and Drug Administration (FDA) or any equivalent regulatory body. It is not intended to diagnose, treat, cure, or prevent any medical condition.
Lumi is not an emergency service. It is a consumer safety tool intended to supplement โ not replace โ direct access to emergency services such as 911.

Lumi's SOS emergency feature attempts to send SMS alerts to your emergency contacts and initiate a phone call to 911. However, Lumi makes no guarantee, warranty, or representation that these features will function correctly in all circumstances, including but not limited to:

If you or someone near you is in immediate danger, call 911 directly from your phone's dialer. Do not rely solely on Lumi's SOS feature in a life-threatening situation.
Because Lumi is delivered as two apps, what the SOS feature can do depends on which apps are installed on the device and how the device is configured:
You are responsible for confirming that SOS behaves as you expect on your own device and for keeping your emergency contacts up to date. In any emergency, call 911 directly.
โ ๏ธ Important โ Please Read Carefully: No scam screening catches everything. Lumi's scam screening is a tool to help you spot suspicious calls and messages. It does not replace your own judgement, and it is not a guarantee that you will never be targeted or deceived.
Lumi Line examines incoming calls and text messages and attempts to identify those that appear fraudulent. Where a message or caller is judged to be a scam, Lumi may block it, warn you about it, or record it for your family to review. However, Lumi makes no guarantee, warranty, or representation that all scams, fraudulent messages, or fraudulent callers will be identified, blocked, or reported, including but not limited to circumstances involving:

Lumi allows a senior user to connect a family member or caregiver ("Supporter") to their account through a 6-digit pairing code. By connecting as a Supporter, you agree to the following:
Both the senior user and any connected Supporters are individually bound by these Terms of Service.
Your privacy is important to us. Our collection, use, and handling of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Lumi, you also agree to the terms of our Privacy Policy.

By adding emergency contacts to your Lumi account, you and your designated emergency contacts consent to receive SMS text messages from Lumi in the event of an SOS emergency. These messages are sent solely to alert emergency contacts of a potential emergency situation involving the Lumi user.
SOS emergency SMS messages are not marketing communications. They are exempt from the prior express written consent requirements of the Telephone Consumer Protection Act (TCPA) because they serve an emergency purpose and are triggered only by a genuine SOS event initiated by the senior user.
Lumi does not send promotional, marketing, or advertising text messages to users or emergency contacts. Lumi does not use an automatic telephone dialing system (autodialer) to send bulk SMS messages.
Any emails we send, including account confirmations, support responses, and service notices, comply with the CAN-SPAM Act. Each email includes our business address, a clear description of the sender, and an opt-out mechanism where legally required. We do not send unsolicited commercial email.

Lumi is not a medical device and does not provide medical advice. Medication names, dosages, and schedules you enter into the App are used only to set reminders and share adherence status with your connected Supporters. This information is not reviewed by any medical professional.
Do not use Lumi as a substitute for professional medical advice, diagnosis, or treatment. Always follow the guidance of your doctor or pharmacist.
Lumi is not subject to the Health Insurance Portability and Accountability Act (HIPAA) because Lumi is not a healthcare provider, health plan, or healthcare clearinghouse as defined by HIPAA. Lumi should not be used in any context that requires HIPAA-compliant data handling.
Lumi is designed for use by adults aged 18 and older. Its primary intended audience is seniors aged 60 and older.
Lumi is not directed at children under 13. By using Lumi, you confirm that you are at least 18 years of age, or that you are a family member or caregiver setting up the App on behalf of an adult senior with their knowledge and consent.
If you are setting up Lumi on behalf of a senior family member, you represent that you have authority to agree to these Terms on their behalf and that the senior user is at least 18 years old.
You agree not to use Lumi in any way that:
Lumi, including its design, source code, branding, logo, and all content, is the intellectual property of Lumi. All rights are reserved.
You are granted a limited, non-exclusive, non-transferable, revocable license to use Lumi for personal, non-commercial purposes in accordance with these Terms. You may not copy, reproduce, distribute, modify, create derivative works of, or reverse-engineer any part of Lumi without our express written permission.
The Lumi™ name, logo, and related marks are trademarks of Lumi. You may not use them without prior written consent.
Lumi relies on third-party services to function, including Google Firebase, Google Maps, Google Play Billing, Anthropic's Claude AI API, OpenWeatherMap, and NewsAPI. Your use of Lumi is also subject to the terms of service and privacy policies of these third parties. Lumi is not responsible for the availability, accuracy, or conduct of any third-party service.
If any third-party service experiences an outage or disruption, features of Lumi that depend on that service may be temporarily unavailable. This includes but is not limited to SOS alert delivery, location sharing, scam detection, weather, and news features.
We reserve the right to suspend or terminate your access to Lumi at any time, with or without notice, if we determine at our sole discretion that you have violated these Terms or engaged in any conduct that harms other users, third parties, or the integrity of the Service.
If your account is terminated for a Terms violation, you are not entitled to a refund of any subscription fees paid.
You may request voluntary account termination and deletion of your data at any time by emailing bowman@getlumicare.com with the subject line "Delete My Lumi Account." We will confirm and complete deletion within 30 days.
Lumi is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties including but not limited to:

To the fullest extent permitted by law, Lumi LLC shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the App โ whether based in contract, tort, negligence, strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
Lumi's total aggregate liability for all claims arising out of or relating to these Terms or the App shall not exceed the greater of:
This limit applies in the aggregate across all claims, and it applies even if a remedy set out in these Terms is found to have failed of its essential purpose.
Some jurisdictions do not permit the exclusion or limitation of certain damages. Where that is the case, only those exclusions and limitations that are lawful in your jurisdiction apply, and Lumi's liability is limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless Lumi and its affiliates, officers, employees, or agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:
Before filing any legal claim, you agree to first contact Lumi at bowman@getlumicare.com and give us 30 days to attempt to resolve the dispute informally.
Binding Arbitration: If the dispute is not resolved informally, you and Lumi agree to resolve it through binding individual arbitration under the rules of the American Arbitration Association (AAA), rather than in court. The arbitration will take place in Oklahoma County, Oklahoma. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver: You agree that any dispute will be resolved only on an individual basis. You may not bring a claim as a plaintiff or class member in any class action, consolidated action, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
Exceptions: Either party may bring an individual claim in small claims court. Either party may also seek emergency injunctive or equitable relief in court to prevent irreparable harm while arbitration is pending.
If the class action waiver is found unenforceable, the entire arbitration agreement shall be void and the parties may pursue claims in court.
These Terms of Service are governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions.
Any legal action or proceeding arising from or relating to these Terms shall be brought exclusively in the state or federal courts located in Oklahoma County, Oklahoma. By using Lumi, you consent to the personal jurisdiction of those courts.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lumi with respect to your use of Lumi and supersede all prior or contemporaneous agreements, understandings, or representations.
We may update these Terms of Service from time to time as Lumi grows or as required by law. When we make material changes, we will update the "Last updated" date at the top of this page and notify you within the App where reasonably practicable.
Your continued use of Lumi after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.
